Reform of the Court of Auditors: a meeting on the new model of financial liability at the University of Insubria on 4 June

The reform of the Court of Auditors redefines the relationship between financial liability, audit activities and the role of public officials, with particularly significant implications for the healthcare sector. These issues are the focus of the meeting ‘The Court of Auditors Reform Act No. 1/2026’, organised by the University of Insubria in the Aula Magna of the Chiostro di Sant’Abbondio in Como on Thursday 4 June and open to the public, including civil servants, lawyers, accountants and healthcare staff. The discussion will focus on the new model of administrative liability, gross negligence, the advisory and supervisory role of the Court of Auditors, limits on compensation for damages, and the relationship with healthcare regulations.

The event, running from 9.30 am to 1.30 pm, will open with institutional addresses by the Rector of the University of Insubria, Maria Pierro, the Director General of ASST Valle Olona, Daniela Bianchi, and the Director General of Welfare for the Lombardy Region, Mario Melazzini, and will feature a comprehensive programme of presentations by university lecturers, magistrates from the Court of Auditors and legal professionals.

The first session is devoted to administrative liability. Professor Emanuele Boscolo of the University of Insubria will speak on ‘The role of the Court of Auditors following the reform introduced by Law No. 1/2026’. There will also be a focus on medical liability, which is likewise subject to review by the Court of Auditors.

Solicitor Angela Sarli will present a paper on ‘Gross negligence: the legal framework and the judge’s interpretative power. Classification of liability for gross negligence’. Professor Gianluca Cavalieri of the University of Insubria will address the topic ‘The good faith of political bodies. The political defence’.

The programme continues with Councillor Ilaria Annamaria Chesta, a magistrate of the Second Appeal Section of the Court of Auditors, who will speak on ‘Compensability of damage. Statutory time limits or waiver of claims. The “dual track” approach’. Emanuela Furiosi of the University of Insubria will focus her contribution on ‘The reputation of the public administration. The protection of this legal interest’, whilst Councillor Adriano Gribaudo, a magistrate at the Liguria Regional Prosecutor’s Office of the Court of Auditors, explores ‘New developments on the statute of limitations. Compulsory insurance for financial loss’.

Proceedings resume in the afternoon with the session ‘Control and advisory activities’. Professor Guido Rivosecchi of the University of Padua speaks on “Preventive review of legality. The Court’s silence and the effects on the liability of officials”. Councillor Innocenza Zaffina, a magistrate of the Veneto judicial section of the Court of Auditors, addresses “The advisory function of the Court of Auditors under Law No. 1/2026”.

The final part of the day is devoted to administrative liability in the healthcare sector. Councillor Francesco Antonino Cancilla, a magistrate at the Sicilian Jurisdictional Section of the Court of Auditors, will speak on ‘The caps on compensation for damages under Law 1/2026 and their relationship with the provisions of Law 24/2017, as well as other contentious aspects between the two sets of legislation’. The programme concludes with a presentation by lawyer Roberto Guida on ‘Gross negligence under Law 1/2026 and the Gelli-Bianco Law: conflicts, initial interpretations and prospects’.

The meeting concludes with a session summarising and discussing the topics covered during the day.
